1. Validity
The following General Terms and Conditions (in short GTC) apply to all purchase contracts between Sandra Milacher and an end customer/consumer (in short the Customer) in the version valid at the time of the order. These GTC do not apply to dealers, merchants and retailers.
2. Formation of a Contract, Storage of the Text of the Contract
2.1 The following regulations on the conclusion of a contract apply to orders placed via our webshop on the website

2.2 In case of conclusion of the contract, the contract is concluded with Sandra Milacher.
2.3 The presentation of the goods in our internet store does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the customer to order goods. By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract.
2.4 The customer makes a binding offer to enter into a contract by successfully completing the order procedure provided in our Internet store.

Before the binding submission of the order, the customer can return to the Internet page on which the customer's data are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the back button contained in the Internet browser used by him after checking his data.
We confirm the receipt of the order immediately by an automatically generated e-mail (Thank you for your order).
2.5 After receipt of the order, we will send the customer the order data and our General Terms and Conditions by e-mail. The customer has to take care that his email account is not overfilled and that emails can be delivered. The customer can also view the GTC at any time at www.youlookperfect.at/policies/terms-of-service. Your order data is no longer accessible via the Internet for security reasons, but is stored electronically by us.
2.6 The purchase contract is concluded with the transmission of an order confirmation, but at the latest with the delivery of the ordered goods.
3. prices, shipping costs, delivery countries, returns, means of payment
3.1 The indicated prices are in EURO and include the value added taxes of the European countries. In third countries 0% value added tax applies.
3.2 We deliver free of charge in standard shipping to EU, Switzerland, Liechtenstein, Iceland, Norway, San Marino, Monaco, USA, Canada, Qatar, Bahrain, United Arab Emirates, Kuwait, Saudi Arabia.
3.3 Express shipping can be added to some countries for a fee and cannot be refunded in the event of a return.
3.4 Information about third countries:
- Switzerland, Liechtenstein:
Minimum order value 100€. We pay customs and shipping for you, but you will be charged the Swiss import tax after receiving the goods from "Gebrüder Weiss AG". You have to pay this invoice also in case of return or exchange.
- USA, Canada, Monacco, San Marino, Iceland, Norway, Qatar, Bahrain, United Arab Emirates, Kuwait, Saudi Arabia:
Minimum order value 100€. We will pay the shipping for you. Please note that there may be costs for taxes and duties when importing, which have to be paid by you. Unfortunately we have no information about their amount. You have to pay these costs also in case of a return.
3.5 Returns: You have an extended right of return of 30 days. If you buy a loungewear set, you can also return individual items. Returns from Germany and Austria can be sent to us free of charge via our returns portal, shipping with DPD and Austrian Post. Returns from all other countries please send at your expense by the shipping method of your choice.
3.6 If the order is returned because it is undeliverable (e.g. because of a wrong delivery address or not accepted), we reserve the right to charge the shipping costs (+ any customs fees).
3.7 The contracting party has, depending on the country, the possibility of payment by means of:
- PayPal
- Apple Pay via the payment service Stripe
- Credit card (Visa, Mastercard, American Express, Maestro) via the payment service Stripe
- Pay now with Klarna: Instant bank transfer via the payment service Klarna Pay now. This is a TÜV-certified online payment system with PIN/TAN entry for secure and fast processing of your online purchases. Klarna - Pay now is the direct transfer method for online purchases. With Klarna - Pay now you conveniently set up a transfer for the respective amount in your online banking account while you are still placing your order. You neither have to register nor do you need a credit card. You pay easily, securely and quickly directly with your online bank account.
- Pay later with Klarna: By invoice via the service provider Klarna Invoice. When buying on account with Klarna, you receive the goods from us and the invoice from Klarna. You have a payment period of 14 days. The payment is made to Klarna, please pay close attention to the correct reason for payment, otherwise the payment will not be assigned and you will automatically receive a remittance and reminder from Klarna.
For payments from third countries or with currencies other than the EURO may be additional fees due to exchange rate changes.
4. delivery
4.1 The delivery of the ordered goods is regularly carried out by shipping. We ship by default with DPD or with DHL Express.
4.2 Unless we have clearly stated otherwise, all items offered by us are ready for immediate shipment. Delivery here is as stated in the order within 1-6 business days (this information is a standard delivery time, not a guarantee). The deadline for delivery begins to run on the day after the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.
4.3 The risk of accidental loss and accidental deterioration of the sold item shall not pass to the customer until the item is handed over to the customer, even in the case of a mail order purchase.
4.4 If a package is obviously damaged during delivery, the customer must insist that this circumstance be recorded in writing by the delivery agent. The customer must notify us in writing (by mail or e-mail) of any damage to a product within 7 days.
4.5 The stated delivery times are standard delivery times and cannot be guaranteed. Especially in countries outside the EU, there may be delays at customs.
5. Retention of title
We retain title to the goods until the purchase price has been paid in full.
6. Right of withdrawal of the consumer
The customer is entitled to a right of withdrawal. Please note that the goods should be complete with labels and without signs of use. Any damage, if necessary, we charge through the resulting reduction in value.

You have the right to cancel this contract within 30 days without giving any reason.
The revocation period is 30 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last item.
To exercise your right of withdrawal, you must inform us (you look perfect Inh. Sandra Milacher, Abtsdorf 170, A-4864 Attersee, Tel. +43-660-1464437, shop@youlookperfect.at) by means of a clear declaration (e.g. a letter or e-mail sent by post or our returns portal) of your decision to withdraw from this contract. You can also use the attached sample withdrawal form for this purpose, which is, however, not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you revoke this contract, we must refund all payments we have received from you (minus any express delivery costs) immediately and at the latest within fourteen days from the day on which we received the returned goods. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged payment fees by us because of this repayment. You must return or hand over the product(s) to us (you look perfect Inh. Sandra Milacher, Abtsdorf 170, A-4864 Attersee) immediately and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the deadline of fourteen days.
Return shipping is free of charge via our returns portal from Germany, Austria, Belgium, Netherlands, Luxembourg, Denmark, Slovakia, Finland, France. From the other countries the buyer pays the return shipping.

7. Warranty and compensation
7.1 The customer is entitled to the statutory right to warranty. The warranty period is 2 years. The warranty only covers defects that already existed at the time of handover. After 6 months, the customer must prove that the defect already existed at the time of handover. A defect does not exist if faults occur in the goods due to improper use or use contrary to the intended purpose.
Minor changes to our performance which are reasonable and objectively justified for the customer, in particular deviations in color shades, shall not constitute defects. We shall bear the necessary costs of the improvement or replacement carried out under warranty, in particular shipping and material costs.
7.2 We shall not assume any liability for damages, in particular not for indirect damages, nor for warranty or product liability, unless mandatory consumer protection provisions provide otherwise.
7.3 If we are liable for damages according to the statutory provisions, our liability is limited to intent and gross negligence. Our liability shall be limited to the amount of the specific contractual remuneration. Any further liability is excluded, unless otherwise provided for by consumer protection laws.
7.4 We assume no liability for the timeliness, accuracy, completeness and content of the information provided.
7.5 The photographs contained in the product description are only exemplary. Due to the uniqueness of the products or due to the materials used, there may be a color deviation or a slight difference in size between the actual product and its image on the Internet, which, however, does not entitle the contractual partner to make a complaint.
7.6 We shall not be liable for any delay in delivery resulting from circumstances beyond our control.
7.7 We shall not be liable in the event of allergies or incompatibilities of the contractual partner to any component of the raw materials used in our products. An allergy or incompatibility of the contractual partner does not entitle him to make a complaint.
8. Set-off, retention
8.1 The customer shall have the right to set-off against claims of ours in the event of our inability to pay or for counterclaims which are legally related to the customer's liability, which have been established by a court or which have been acknowledged by us.
8.2 The customer shall be entitled to the statutory rights of retention.
9. Duty to inform
When registering your data, we depend on your truthful information. If your data changes (especially name, address, e-mail address, telephone or bank details) please inform us immediately. Please make sure that the e-mail address you have provided is accessible and that the receipt of e-mail messages is not precluded due to shutdown or overfilling of the e-mail account or classification as spam. If you provide false data, Sandra Milacher is entitled to withdraw from the contract and to charge a handling fee. The declaration of withdrawal must be made in writing. The written form is also preserved by e-mail.
10. Applicable Law, Place of Jurisdiction, Place of Performance, Written Form.
10.1 Austrian law shall apply to the exclusion of the referral norms of international private law and the provisions of the UN Convention on Contracts for the International Sale of Goods. This choice of law shall apply with the exception of the mandatory provisions of the law of the customer's habitual residence.
10.2 The statutory mandatory places of jurisdiction for consumers shall apply.
10.3 The place of performance shall be the registered office of Sandra Milacher, Attersee, Austria.
10.4 Amendments and supplements to this contract must be made in writing; this also applies to subsidiary agreements and subsequent amendments to the contract, as well as the absence of the written form requirement.
11. Contract language
German shall be the sole language of the contract.
12. Data protection
Personal data such as first name, last name, address, zip code, city, telephone number, e-mail address, date of birth are collected when you place an order in order to process these orders and to be able to ship the ordered goods.
When you place an order via the online store, we protect your data with a secure SSL connection. We process and use personal data for order processing, to maintain customer relations and for our advertising approaches.

13. Severability clause
Should any provision in these General Terms and Conditions be or become invalid, this shall not affect the validity of the other provisions. The invalid provision will be replaced by a valid provision that comes closest economically and legally to the provision to be replaced.
